H-1B friendly, with Employer of Record support
Yes — Silicon Tek works with H-1B professionals, including H-1B transfers. And when a client company doesn’t do H-1B transfers, Silicon Tek can be the Employer of Record (EOR), so employers get the talent they want and consultants get the role they want.
Yes, we do H-1B transfers
We hire and place H-1B professionals across software, data, AI, cloud and business-systems roles, and we can file H-1B transfer petitions for eligible candidates we hire.
- Clear conversations up front about your status and the role’s requirements
- W-2 employment with Silicon Tek, with payroll and compliance handled for you
- Support through onboarding and while you’re on assignment

When the client doesn’t do H-1B transfers, we can be the employer
Silicon Tek acts as the legal employer — paperwork, payroll, taxes, compliance and, where eligible, the H-1B transfer — while the client directs the work. It works for both sides.
For employers
- Hire the consultant you’ve chosen even if your company doesn’t sponsor or transfer visas.
- Silicon Tek employs the consultant and handles onboarding, payroll and employment compliance.
- You focus on the work; we handle the employment side and bill you for the engagement.
- Also useful for candidates you sourced yourself — bring them to us and we’ll be the employer of record.
For consultants
- Found a client who likes you but won’t do an H-1B transfer? Ask them to engage you through Silicon Tek.
- Where you’re eligible, Silicon Tek can file your H-1B transfer and employ you on W-2.
- You get one point of contact for pay, paperwork and questions while you’re on assignment.
- Not on H-1B? EOR also works for other employment-authorized consultants.

Common questions
Does Silicon Tek work with H-1B candidates and do H-1B transfers?
Yes. We work with H-1B professionals and can file H-1B transfer petitions for eligible candidates we hire, subject to U.S. immigration requirements.
What does “Employer of Record” (EOR) mean?
Silicon Tek becomes the consultant’s legal employer — we handle the employment paperwork, payroll, taxes and compliance — while the client company directs the day-to-day work. The client gets the person they want without having to sponsor or transfer a visa themselves.
My client doesn’t do H-1B transfers. Can I still work there?
Often, yes. If the client is open to engaging you through Silicon Tek, we can act as your employer of record and, where you’re eligible, file your H-1B transfer to Silicon Tek. Contact us with the role details and we’ll review your situation.
We found a great candidate but our company doesn’t sponsor visas. Can you help?
Yes. Introduce us to the candidate. If they’re eligible, Silicon Tek can employ them as the employer of record and place them on your project, so your team doesn’t take on visa sponsorship.
Do you work with OPT, STEM OPT, H-4 EAD or L-2 candidates?
We work with candidates who hold valid U.S. employment authorization, including OPT / STEM OPT, H-4 EAD and L-2 spouses with work authorization. Some clients set their own requirements for a role, and we’ll tell you up front if a role is limited to certain statuses.
Do you offer W-2 and corp-to-corp (C2C)?
Yes. We place consultants on W-2 with Silicon Tek, and for many roles we also work corp-to-corp with partner firms. Ask your recruiter which options apply to a specific role.
How long does a transfer take, and what does it cost?
It depends on the individual case and on government processing, so we don’t publish timelines or fees. We’ll talk through your specific situation before you make any decisions.
What documents will I need?
Every new employee completes the federal Form I-9 employment eligibility verification. Please don’t upload passports, visas, I-94s or Social Security numbers through our website — when documents are needed, we’ll tell you exactly what and how to share them securely.
